LIMITED USER SOFTWARE LICENSE AGREEMENT

This Limited Use Software License Agreement (the "Agreement") is a legal agreement between you, the end-user, and NuGardt Software and/or the author (Kevin Oliver Gardthausen). BY CONTINUING THE INSTALLATION OF THE FULL VERSION PROGRAM ENTITLED »Seismovision 3« (THE "SOFTWARE"), BY LOADING OR RUNNING THE SOFTWARE, OR BY PLACING OR COPYING THE SOFTWARE ONTO YOUR COMPUTER HARD DRIVE, COMPUTER RAM OR OTHER STORAGE DEVICE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT.

1. >> DISTRIBUTION AND OTHER <<
You may NOT distribute this software in the internet or any other data transfer or storage medium without explicit written permission from the author. The author and/or NuGardt Software do not take any responsibility for any side effects this program may cause. If the use of this program should result in any damage to, or the loss of data on your system, you automatically waive all claims against the author and/or NuGardt Software. This program has been thoroughly tested to prevent damage or data loss. When this software is used commercially, registration is required. The official Seismovision web-site is http://www.seismovision.net.

4. >> REGISTRATION <<
Purchases of the product are only done by using the online provider 'PayPal'. Payments done can and will not by any means be refunded for any reason whatsoever. The author has no action in the registration process but receives carbon-copies of all registrations done. No personal data/addresses/e-mail and so on provided by the registrant (end-user) will be made public or sold or otherwise used. By registration, the end-user receives a serial key provided by the the author to activate the software for full use. The end-user agrees that his/her key(s) may not be distributed to any one else. No one will ever ask for the key, not even the author. Leaked/distributed keys will be black listed and banned from the software without prior warning. Lost keys can be recovered by supplying registration data to acknowledge the identity of the end-user as the true registrant to the e-mail address provided by the author. The end-user may use the key on multiple personal computers (PC) which are his/her own to: one (1) work PC, one (1) home PC and one (1) mobile PC/notebook/laptop/tablet (maximum of three (3)). Another registration is required for more personal computers. When this software is used commercially, registration is required per PC. The use of key generators (keygen), cracks (crackz), hacks (hackz or hax) or otherwise illegally obtained keys is strictly prohibited. 'PayPal' does not support or endorse this software.

The web-sites http://www.planetquake3.net, http://www.planetquake4.net and http://www.quakeunity.com are run by Roger 'RogeR' LaMarca and is the web-host of Seismovision. PlanetQuake3.net, PlanetQuake4.net and QuakeUnity.com have no responsibility for the software or web-site content of Seismovision.

6. >> MICROSOFT <<
Microsoft is not a party to this Agreement, and shall have no liability whatsoever with respect to the services that are the subject of this contract. Each applicable Microsoft Certified Professional Designation (which may include one or more of the following titles: Microsoft Certified Professional, Microsoft Certified Professional + Internet, Microsoft Certified Professional + Site Building, Microsoft Certified Database Administrator, Microsoft Certified Solution Developer, Microsoft Certified Trainer, Microsoft Certified Systems Engineer and/or Microsoft Certified Systems Engineer + Internet, Microsoft Certified Systems Administrator, Microsoft Certified Application Developer) indicates that I have successfully completed Microsoft's corresponding certification requirements, which reflect commensurate skills required to implement, support, and maintain solutions with relevant Microsoft products. The services I provide under this contract are not provided, licensed, or sponsored by Microsoft.

YOU ACKNOWLEDGE THAT YOU HAVE READ THIS AGREEMENT, THAT YOU UNDERSTAND THIS AGREEMENT, AND UNDERSTAND THAT BY CONTINUING THE INSTALLATION OF THE SOFTWARE, BY LOADING OR RUNNING THE SOFTWARE, OR BY PLACING OR COPYING THE SOFTWARE ONTO YOUR COMPUTER HARD DRIVE OR RAM, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. YOU FURTHER AGREE THAT, EXCEPT FOR WRITTEN SEPARATE AGREEMENTS BETWEEN THE AUTHOR AND/OR NUGARDT SOFTWARE AND YOU, IF ANY, THIS AGREEMENT IS A COMPLETE AND EXCLUSIVE STATEMENT OF THE RIGHTS AND LIABILITIES OF THE PARTIES HERETO. THIS AGREEMENT SUPERCEDES ALL PRIOR ORAL AGREEMENTS, PROPOSALS OR UNDERSTANDINGS, AND ANY OTHER COMMUNICATIONS BETWEEN THE AUTHOR AND/OR NUGARDT SOFTWARE AND YOU RELATING TO THE SUBJECT MATTER OF THIS AGREEMENT.
